This summary is here to help you understand the terms. The full terms below are what legally applies.
getxirfad is a marketplace where clients hire freelancers for online services. Your payment is held safely by getxirfad and is only released to the freelancer after the work is delivered and you approve it. Freelancers work for themselves, not for getxirfad. You must be at least 18 to use getxirfad, you may have only one account, and you must keep your transactions on the platform. getxirfad charges service fees which are shown to you before you pay. If something goes wrong, either side can open a dispute and getxirfad will review the evidence and decide. getxirfad is currently in beta, which means the service is still being improved and features may change.
getxirfad is an online marketplace for freelance services, operated under the business name getxirfad.com, Mogadishu, Somalia (the operator). In these terms, "getxirfad", "we", "us" and "our" refer to the operator, and "you" refers to any person who uses the service. The service includes the getxirfad mobile application, the website getxirfad.com, and related services.
If the operator incorporates or transfers the service to a company, these terms and your agreement to them transfer automatically to that company, and we will update these terms to reflect the new entity.
By creating an account or using getxirfad, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the service.
We may update these terms from time to time. When we make material changes, we will notify you inside the app or by email, and the updated terms will apply from the date stated in the notice. If you continue using getxirfad after that date, you accept the updated terms.
You must be at least 18 years old to use getxirfad. By creating an account you confirm that you are 18 or older and legally able to enter into contracts. getxirfad is not intended for anyone under 18, and we will close accounts that we reasonably believe belong to minors.
One person, one account. Each person may hold one getxirfad account. Your single account can be used in Hire mode (as a client) and in Work mode (as a freelancer). Creating multiple accounts, buying, selling, renting or sharing accounts is prohibited.
Accurate information. You must provide truthful and current information on your account and keep it up to date. Impersonating another person or business is prohibited.
Security. You are responsible for keeping your login credentials secure and for all activity that happens under your account. Tell us immediately at support@getxirfad.com if you believe your account has been compromised.
getxirfad is a marketplace and a payment protection service. When a client hires a freelancer, a service contract is formed directly between the client and the freelancer. getxirfad is not a party to that contract, does not perform the work, does not employ the freelancers, and does not guarantee the quality, legality or outcome of any work, although we provide the tools described in these terms to protect both sides.
Freelancers are independent contractors. Freelancers on getxirfad work for themselves. Nothing in these terms creates an employment, agency, partnership or joint venture relationship between any freelancer and getxirfad. Freelancers are solely responsible for their own taxes, registrations and legal obligations arising from their earnings, and clients are responsible for any obligations arising from their purchases.
No income guarantee. getxirfad does not guarantee that freelancers will receive orders or income, or that clients will find a suitable freelancer for every need.
An order on getxirfad moves through clear stages, and the app shows you the current stage at all times.
Requesting. A client selects a service and sends an order request. The client may propose a price that differs from the freelancer's listed price. The proposed price is an offer, not a final agreement.
Acceptance. The freelancer reviews the request and either accepts it or declines it with a reason. No contract exists, and no payment is due, until the freelancer accepts. Once accepted, the agreed price is the price shown on the order.
Payment into escrow. After acceptance, the client pays the agreed amount into escrow as described in section 7. The freelancer should not begin work until the app shows the order as paid.
Delivery. The freelancer delivers the completed work through the app, together with a delivery note.
Approval and release. The client reviews the delivery. When the client approves it, the order is complete and the payment is released to the freelancer, less applicable fees.
Reviews. After completion, both sides may leave one review of the other. Reviews must be honest and based on the actual order.
Escrow is the core protection getxirfad provides. It works as follows.
Paying into escrow. After a freelancer accepts an order, the client sends the agreed amount to the getxirfad payment account shown in the app, using one of the supported payment methods. The client then submits payment details in the app, including the number the money was sent from, the amount sent, and either the transaction reference from the payment confirmation message or a screenshot of the payment. getxirfad then verifies that the money has actually been received.
Confirmation. An order is only treated as paid after getxirfad confirms receipt of the money. Until getxirfad confirms, the order remains in payment review, the freelancer is instructed not to begin work, and no delivery can be made. Submitting payment details does not by itself make an order paid. Submitting false payment claims is a serious violation of these terms and may lead to permanent removal from the platform.
If a payment cannot be confirmed. If we cannot match a submitted payment claim to money received, we will reject the claim with a reason, the order returns to awaiting payment, and the client may submit corrected details.
Holding. Confirmed payments are held by getxirfad and are not available to the freelancer until the order is completed as described in section 6, or a dispute is resolved as described in section 11.
Release. When the client approves the delivery, or a dispute is resolved in the freelancer's favour, the payment is released to the freelancer, less applicable fees.
Manual processing during beta. During the beta period, payment confirmation and release are performed manually by the getxirfad team. We aim to process them promptly, but they are not instant. As we integrate automated payment services, parts of this process will become automatic, and these terms will continue to apply to the automated process.
Payouts and verification. getxirfad may require identity verification before releasing funds to a freelancer, and may require that the registered name on the payout account or mobile money wallet matches the verified identity of the account holder. This protects everyone against fraud and stolen accounts.
Third party payment services. Payments travel over third party services such as mobile money networks and banks. Those services are not operated by getxirfad, and getxirfad is not responsible for their availability, delays or failures. Money is only treated as paid into escrow once we have actually received it.
getxirfad charges service fees on transactions. The applicable fees are shown to you in the app before you pay or accept an order, and are set out in the Fee Schedule as published in the app, which may be updated from time to time. Fee changes apply to new orders, not to orders already paid into escrow. Where a promotional offer applies, such as reduced fees for a first transaction, the offer terms shown in the app apply.
Before acceptance. A client may cancel an order request at any time before the freelancer accepts it.
After acceptance, before payment. Either side may cancel an accepted order before payment is confirmed, and we encourage communicating through the order chat first.
During payment review. A client should only cancel during payment review if they have not actually sent any money. If money has already been sent, do not cancel. Contact support instead so we can locate and resolve the payment.
After payment. Once an order is paid, it can only end by delivery and approval, or through the dispute process in section 11.
The client is expected to review deliveries promptly and either approve the work or raise a dispute. Approval releases the payment and completes the order. Repeatedly failing to respond to deliveries may be treated as a conduct issue under section 14.
If something goes wrong on a paid or delivered order, either the client or the freelancer may open a dispute in the app, stating the reason. While a dispute is open, escrow actions are paused.
Self resolution. The person who raised the dispute may withdraw it at any time, which returns the order to its previous stage.
getxirfad resolution. If the dispute is not withdrawn, getxirfad reviews the order, the delivery, the payment records and the order communications, and decides the outcome. getxirfad may release the payment to the freelancer, refund the payment to the client, or return the order to its previous stage for the parties to continue. getxirfad's decision on a dispute is final within the platform.
Refunds. When getxirfad refunds an escrow payment, the refund is the full amount held in escrow for that order and is returned to the same payment account or wallet the money came from. During beta, refunds are processed manually and may take a reasonable time to complete.
Evidence. To resolve disputes fairly, getxirfad may review the messages exchanged in the order chat, the delivery files and notes, and the payment records connected to the order. By using getxirfad you consent to this review for dispute resolution, fraud prevention and safety purposes.
The trust and protection getxirfad provides only work when transactions stay on the platform. You agree not to use getxirfad to find a client or freelancer and then move the payment or the work off the platform to avoid fees or escrow. This includes sharing payment details, phone numbers or external contact information for the purpose of transacting outside getxirfad. Circumvention harms the other party by removing their payment protection, and it is a serious violation that may lead to suspension or permanent removal.
getxirfad offers identity verification for freelancers and clients, and displays a verified badge on verified accounts. You agree to provide truthful documents and information when you apply for verification. Submitting forged, altered or another person's documents is a serious violation. getxirfad may require verification for certain actions, including receiving payouts, and may re verify accounts when we have a safety or fraud concern.
You agree that you will not use getxirfad to:
offer, request or deliver services that are illegal in Somalia or in your own location, or that facilitate illegal activity; offer or deliver services involving weapons, drugs, gambling, adult content, or the exploitation or endangerment of any person, especially minors; harass, threaten, insult or discriminate against other users; post or send fraudulent, misleading or deceptive content, including fake portfolios and false claims of skills or credentials; manipulate reviews, including leaving false reviews, trading reviews or pressuring the other party over a review; submit false payment claims, false disputes or false reports; interfere with the operation or security of the service, or access it by automated means without our written permission; use the service while your account is suspended, or create a new account to evade a suspension or ban.
getxirfad may moderate content and conduct, and may remove content that violates these terms.
getxirfad may issue warnings, temporarily suspend accounts, or permanently remove accounts for violations of these terms, with the seriousness of the response matched to the seriousness and repetition of the violation. Where reasonably possible, we will tell you the reason. Zero tolerance violations, including fraud, false payment claims, endangerment of others and illegal services, may result in immediate permanent removal.
If your account is removed or suspended while orders are in progress, we will handle the affected escrow funds fairly under sections 7 and 11, and lawful obligations survive the end of your account.
Delivered work. Unless the client and freelancer agree otherwise in the order or order chat, ownership of the delivered work transfers to the client when the order is completed and the payment is released. Until then, the work remains the freelancer's. Freelancers must not deliver work that infringes someone else's rights, and must have the necessary rights to everything they deliver.
Your content on getxirfad. You keep ownership of the content you post on getxirfad, such as your profile, portfolio and reviews. You grant getxirfad a non exclusive, worldwide, royalty free licence to host, display and reasonably promote that content as part of operating the service. Portfolio items must be your own work or work you have the right to display.
getxirfad's property. The getxirfad name, brand, app, website and software are the property of the operator, and these terms do not grant you any rights in them beyond normal use of the service.
Infringement reports. If you believe content on getxirfad infringes your rights, contact support@getxirfad.com with details, and we will review it.
getxirfad sends service emails about your account and your orders, such as order updates, payment confirmations and verification results. These are part of the service. Marketing communications, where offered, will be optional. Communication between clients and freelancers about an order should happen in the order chat, which keeps a record that protects both sides and can be reviewed under section 11.
Our Privacy Policy at getxirfad.com describes how we handle personal data, and forms part of your agreement with us.
You may delete your account in the app settings. Deletion is blocked while you have active orders, to protect the other party. When your account is deleted, your profile is anonymised and your profile media, portfolio and verification files are removed. Records that protect other users and satisfy legal and accounting needs are retained even after deletion, including delivered work files connected to other users' orders and payment evidence such as payment claims and payment screenshots. Deleted accounts cannot be reopened.
getxirfad is currently offered as a beta service. This means the service is still being developed, features may change, be added or be removed, and occasional interruptions or errors may occur. We work to keep the platform reliable and to protect escrow funds at all times, but you accept that a beta service is provided as is and as available.
To the fullest extent permitted by law: getxirfad provides the platform as is and as available and disclaims all warranties not expressly stated in these terms; getxirfad is not liable for the acts, omissions, work quality or conduct of clients or freelancers; getxirfad is not liable for failures of third party services, including mobile money networks, telecoms, app stores and email providers; getxirfad is not liable for indirect, incidental or consequential losses, including lost profits and lost opportunities; and getxirfad's total liability to you for all claims connected to the service is limited to the greater of the total fees you paid to getxirfad in the six months before the claim, or fifty US dollars. Nothing in these terms limits liability that cannot lawfully be limited, and nothing removes our obligation to handle escrow funds as described in section 7.
Force majeure. getxirfad is not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, conflict, government actions, power and network outages, and failures of third party infrastructure.
If your violation of these terms, your content, or your conduct on the platform causes a claim by a third party against getxirfad, you agree to compensate getxirfad for the losses and reasonable costs arising from that claim.
These terms are governed by the laws of Somalia, and disputes between you and getxirfad that cannot be resolved through support will be handled by the competent courts in Mogadishu, Somalia. Upon incorporation of the operating company, this section will be updated, and the updated version will apply from the date of the notified change under section 2. Nothing in this section removes consumer protections that mandatorily apply in your place of residence.
These terms and the Privacy Policy are the entire agreement between you and getxirfad about the service. If any part of these terms is found unenforceable, the rest remains in effect. If we do not enforce a part of these terms at some moment, that is not a waiver of it. You may not transfer your agreement or your account to anyone else. We may transfer our rights and obligations under these terms to a successor entity, including the company formed to operate getxirfad, and section 1 explains that transfer.
